1. Agreement to Terms

By purchasing a license or using the Aqualytix software, you agree to be bound by these Terms. These Terms constitute a legally binding agreement between you (the "User" or "Coach") and Aqualytix LTD, a company registered in the United Kingdom.

2. License Grant & Restrictions

Subject to your payment of the applicable fees, we grant you a non-exclusive, non-transferable license to use the Aqualytix software locally on your devices.

  • Local Processing: All video analysis is performed locally. You are responsible for the hardware requirements and data storage of your video files.
  • Activation: Your software requires an internet connection periodically to verify license validity against our database.
  • Prohibitions: You may not reverse engineer, decompile, or attempt to extract the source code of our software.

3. Video Content & Compliance

Your Legal Obligations

Aqualytix LTD provides the tool; you provide the data. You represent and warrant that:

  • You have obtained all necessary consents (including parental consent for minors) required to film and analyze athletes.
  • Your use of the software complies with all local sports governing body regulations and data protection laws (UK GDPR).
  • Aqualytix LTD is not liable for any misuse of video data or unauthorized distribution of analyzed content by the User.

4. Subscriptions & Payments

Payments are processed securely via Stripe. Subscriptions renew automatically unless cancelled. Since our software is a digital product delivered via license key, refunds are generally not provided once a key has been activated, except where required by UK consumer law.

5. Limitation of Liability

To the maximum extent permitted by law, Aqualytix LTD shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the software, including but not limited to loss of data or hardware failure.

6. Governing Law

These Terms are governed by and shall be construed in accordance with Scots Law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish Courts.
